Hello,
Recently, I received an e-mail from Amazon that I need to submit a documentation including SOR/2001-269 for the verification of my products and in order to be compliant(Consumer Chemicals and Containers). Otherwise, all these listings will be closed.
Up to now, we were asking only for the MSDS for the verification. Now they are rejecting the MSDS and asking for some test reports. These are:
. Test reports from an ISO 17025-accredited laboratory that show that the product complies with the regulations, standards, and requirements listed in the help page
• CoC (Certificate of Conformity) issued by an accredited lab that shows that the product complies with the regulations, standards, and requirements listed in the help page
• Safety data sheet
• Child-resistant packaging (CRP) certification, as applicable
Our products are not flammable, also not toxic or corrosive. These are not classified as hazardous materials. It is not clear to me if Amazon is asking all these test reports or one of them. This is not mentioned. I wonder if Amazon is asking for these test reports by all sellers who are selling any kind of liquids?
I tried to contact some companies in the accelerator and also the Health Canada’s Consumer Product Safety Program. Unfortunately, nobody could give any exact recommendation. Can anyone help me how to solve this issue? Thank you

I'm having similar issues with almost 1000 products. Amazon seems to have recently broadened their definition of what products fall under this law. I can see that house paint falls under the provisions of this law. However, Amazon is now asking for testing on any listing that includes the word paint in it. This includes watercolor paint, acrylic paint and similar items used by adult artists.
Amazon is also including artist palettes that do not include any liquids or chemicals and can't be used as a container. I don't have SDS for these items because they are just flat sheets of glass or plastic. They are not accepting any of my appeals even on these palettes that clearly don't fall under this law.

In my experience when the compliance team is requesting documentation they are generally requesting the entire list of tests be completed. However I can review your most recent Case and see what details are available if you provide the Case ID. Thank you for your understanding.

I made several contacts in the service provider network in order to find a company. But none of them could provide such tests. Do you know which company does that?

In general I'm not able to provide guidance on where you should get your testing done. I would recommend reaching out to your own compliance expert to ensure you know exactly how to complete your testing for these products. As I understand from the discussions in the forum related to this topic, Amazon is closing a lot of listings of many sellers due to lack of some tests. Some of the sellers claim there are not such tests. Some of them did these tests, however there were not accepted by Amazon. I could not find any laboratory doing these tests. I also find it too risky to pay over 15000-20000 USD as paid by some sellers for some tests where it is not clear whether it is going to be accepted or not by Amazon. Eventually, Amazon is not clearly addressing where to get these tests. Today, almost half of my listings were deactivated. I am selling my products through FBA channel. Since I am an international seller, I cannot send my FBA inventory back. I expect from Amazon Canada to be more helpful to the sellers regarding this topic since there are lots of sellers falling in this category and selling over years in Amazon. Regards,

Hello,
I contacted AM Testing which I found in service provider network of Amazon and asked for the certification of these products according to SOR/2001-269. I submitted the MSDS and photos of the products for inspection.
They replied that SOR/2001-269 is the required regulations for spray bottle containers and it does not apply for the products we offer on Amazon since our products are not spray bottle.
I can forward this e-mail or send the screenshot of it to you.
Since SOR/2001-269 is not the required regulations for our products on Amazon, I kindly ask to reinstate them. I also opened a case 17772856531 about this issue. Can you please escalate this. This is an urgent issue since our products are all stranded. Thanks for your help!

So the regulation isn't just about spray bottles but is about hazardous chemicals and their labels. And if your products is not considered hazardous you do not need to have labels compliant for this. Perhaps in your case you need to prove that through testing it does not actually fall under this regulation.
Amazon also doesn't seem to know what they need. I understand anyone can slap on a label and say it is compliant, so it sounds like amazon wants proof that it is or isn't part of this regulation, then some certification saying the label complies if it is. Unfortunately amazon isn't specifying what lab tests it wants to prove this.
This is very confusing. We sell a few big retailers in Canada and they don't even scrutinize our products like this.
Hopefully someone figures it out and can share it with the rest of us.

If this regulation is for hazardous materials and/or spray bottles, than it is obvious to which type of products it should be applied. I contacted the AM testing Lab, they are doing such tests as they claim in the service provider network. After checking the MSDS and the product images, they confidentialy concluded that these regulations do not apply for the products we offer since they are not hazardous and also not spray bottles. Taking into account, that this laboratory is recommended by Amazon itself, I think I deserve the right to expect that Amazon accepts the conclusion of this laboratory.
