New QST Rules Announced in Quebec Budget

Under the old rules anyone who was not a Quebec resident did not have to register for QST. The intent of the budget is that all QC sales on Amazon will have to be reported as taxable at some point in 2019. You will have a $30k annual exemption but that will not apply to the portion of your sales on platforms (ie Amazon) that do more than $30k in annual sales in Quebec. It looks like the intent is for Amazon to collect and remit QST on behalf of 3P sellers but that isn’t finalized yet.

The federal government made a big deal with Netflix that left Quebec unhappy so that aspect of the budget dominated the media.

From what I have read and from tax professionals I have spoken with, the intention is clearly that all sales into Quebec on Amazon and other ecommerce platforms for both corporeal and incorporeal (ie. physical and digital) sales are going to be subject to QST starting at some point in 2019.

Like I said, they haven’t ironed out the details yet so this is something to check back on in a few months if Amazon doesn’t start collecting the tax on behalf of 3P vendors.

Hi All

It will even the play field in QC for all, as we are QC sellers and we see customers buying from non QC residents in order not to pay taxes, while we have to add tax and remit HST and GST to other provinces too.
Frankly, it would be better if Revenue Quebec merges with the CRA… a lot less hassle

I edited my posts on this thread to correct a couple of mistakes. 1) if you have less than $30k in annual sales (not $30) in sales to Quebec residents, you will have to register (this is currently not the case unless you are a Quebec resident). And 2) the regular QST provides ITRs, not ITCs like the GST/HST. As far as I am aware, you cannot apply ITRs to the GST/HST, at least not outside of Quebec. I believe that Quebec is unique in the fact that they collect the GST/HST on behalf of the federal government in Quebec so I have no idea how it works for Quebec residents.
