Utility Patent Violation Over 3 Weeks

I’ve seen that you’ve helped others with patent violation issues, and I’m hoping you might be able to assist me as well.

I recently received a utility patent violation notice for a product I have listed. However, the utility patent cited does not actually cover the product I’m selling, the rights claimed do not apply to my item. It seems the complainant may have submitted the full patent in hopes that doing so would result in my listing being taken down, despite it not being relevant.

To address this, I submitted a letter of non-infringement from my legal counsel on March 18, 2025, and the estimated processing time was 2–3 business days. It's now been nearly three weeks, and I have not received an update. I also followed up with Account Health to escalate the matter after 10 business days but have not heard back.

I’d greatly appreciate any help or guidance you can provide in moving this matter forward.

Are you sure is was Amazon who issued the complaint or your competitor. The main reason this happens is because an unsavory competitor filed an infringement report on you.

All they have to do is call themselves an Agent for the company/product, give a fake email contact address, and the Auto-Bot shuts you down. How you have to join the long, long line of other sellers waiting in the same line to get, if any help, at all.

When you respond, the same email is always sent as a response. The complainant must be the one who has to respond, clearing things up, not you.

Of course, the complainant is not going to do anything because they got what they knew they would get; You not selling the product. For many years I have said on these threads, the process is broken.

Dougal here and thanks for including the complaint ID. I am not a lawyer or an expert on patent law, but from reading through the complaint and patent, I do not think the issue is as cut and dry as you described here. I do not have the access to review the letter of non-infringement you stated here that you submitted, but based on how they were titled and that you included a country in that title, that could be where the disconnect. The country listed in the title of the letter is a different country than the country in which the patent was filed and claimed in the enforcement action. The patent that you are allegedly infringing on is robust and has a significant number of claims associated with it. I advise connecting with an attorney to review the patent claiming infringement compared to your product and continue to submit your response via the Account Health violation workflow.
