A Chinese seller duplicated my product and is selling it as their own
First let me state that I'm in the process of getting my brand registered and also working on a copyright of my design, but I'm not there yet. Yes, this was a wake up call for me.
I created this product 10 years ago and it is my exclusive design. No one else sells it nor has the ability to sell it as I make it in house. A Chinese seller listed my item about a month ago, so I placed a test order and received my exact design back. The end product was not up to par with mine, but they clearly got hold of my design and reverse engineered it and took molds of all the parts and reproduced it.
What recourse do I have. I really need my copyright and brand resolved so I have some legal backing, but I can't make that happen overnight.
They of course are undercutting me in price.
How do approach Amazon if my brand is not yet registered? Do I just have to wait for that to happen? My copyright is still about 3 months from being finalized.

My attorney that is filling the copyright said I can pay a hefty fee to expedite the copyright filling and have it in as few as 2-3 weeks (instead of 4 months).
Do you feel that having a copyright in hand would be powerful enough to get Amazon to shut them down?

This is rampant. Happened to all of our best sellers. They bundle multiple items together and sell them for less than your 1 item. Sometimes they will even use your images.

Is he doing this in China? If you are unaware patent/trademark/copyright in America means nothing to [Moderator Edit: removed inappropriate commentary] sellers.
Lets say that having this somehow gets amazon to remove them from the listing. Will that keep them from selling it under a different name or listing? Will that prevent them from continuing to produce them? Will that prevent them from selling them on every other platform? Will that prevent them from wholesaling them at prices so low you will be fighting dozens of other sellers.
More importantly if they made their own molds how quickly can they edit them to produce a "new" variation of it not covered by your paperwork?
I am not trying to be negative here. I have fought an almost similar battle years ago over my own personal art. It did not go well. I still see knockoffs of my designs in many places including here on amazon.

This is the norm on Amazon. [Moderator Edit: removed inappropriate commentary] sellers will copy and steal your product 10 times over and undercut your price significantly. They don't care. It's all about stealing sales from you. That is their business culture. Unethical and blackhat. They will also copy your bullet points, images and everything else to the exact T. You have a short window to make the most of your product on Amazon. Within 6 months, it will be copied by a [Moderator Edit: removed inappropriate commentary] seller.

Can you redo your molds or designs to have your name in place for authenticy of original? Thats what I have done and place in description or a new picture to show this.
