Cosmetic products incorrectly idenfitied as NHP or Drug products

Hi all,

We have had about 15 ASINs over time incorrectly flagged as either Drug or NHP related products, but they are actually cosmetics and do not fall under those regulations.

The most recent one that happened a week ago is our best seller, which has sold a lot units already in Canada for a few years and suddenly it is flagged.

The problem, is that every appeal, with the information needed, just gets rejected and an automated message returned.

My fear is that the system has marked them as these, so every time we appeal, it is a bot/AI that checks the listing to see if we have added the NPN or DIN number (which we wont be able to as our product is incorrectly identified), and without manual review where they will see straight away the error, we will never get passed this issue.

Does anyone with any advice on how to get this escalated? This is a big big problem for us that we need to find a solution to or we lose the Canadian platform completely.

hello !

i have recently launched my first product listing ( hair spray serum) all natural and no drugs in product, plus i got a Health Canada cosmetic number after sending them the exact ingredient concentrations. Amazon then flags my product as considered a restricted product violation due this generic message : "This product has been identified as Natural Health Product (NHP) or drug product, and it is subject to the provisions of the the Food and Drugs Act (FDA) and its regulations. All NHPs and drug products must be licensed by Health Canada, meet labelling requirements and comply with the terms of their market authorization. Amazon policy prohibits the sale or listing of unlicensed NHPs and drug products."

i keep attaching email communication with health Canada about my product and how its not considered a drug and i also attached actual label with warnings in french and english but they keep sending me the same generic message in the case logs.

anyone help with this ?
