Ongoing Trademark Infringement & Unauthorized Sellers on Amazon.ca

We’re a registered brand in Amazon’s Brand Registry and we’re struggling with unauthorized sellers listing our products on Amazon.ca—specifically under ASIN B07MTGD3D9. These sellers are consistently undercutting our price, taking over the Buy Box, and hurting both our brand integrity and customer experience.

We’ve submitted multiple IP infringement reports through Brand Registry, but they are coming back as “not accepted”—with no clear explanation. We're not just frustrated about individual reports being denied… we're trying to figure out how to prevent this from happening in the first place.

Had luck using Transparency or other Amazon tools to block unauthorized sellers?

Got Amazon to take stronger enforcement actions?

Do you have a trademark for your Brand in Canada? Have you verified that the items are counterfeit with a test buy?

This exact thing happened to my products. Unauthorized amazon sellers based from china were stealing my products, dropping the price, stealing the buybox, so I would begin price wars with them to shake them off my listing. The reason they were able to do this is because my trademark is still pending with the Canadian trademark office. Until the trademark is fully registered, not just pending, I will get access to amazon transparency. Do you have a registered trademark in Canada/have access to amazon transparency? This could be the solution to your problem. Otherwise, you will have to keep a close eye on your products, make sure that you are still winning the buybox, send cease and desist letters to the unauthorized sellers, drop your price to beat theirs and win the buybox, etc... Under the account health section, on the top right, you can report abuse. If your trademark is not registered yet, your best option is to select the 'another seller is attempting to harm my business' and fill out all the info. This has worked very well for me and unauthorized sellers were taken down just a few hours after it was submitted. It is a very exhausting process but after a while they will give up. As of right now they have left my products alone for a few weeks, after a full month of relentlessly stealing my products. It is a very scary thing because if one of your customers purchases from this unauthorized seller, who knows what the customer will be shipped, and any issues will reflect on your listing and your amazon account... Hope this was helpful, but there is not much you are able to do in this case unless you are using a registered trademark in Canada.

test buy and then report, Amazon will take down list within 30 mins, but if that seller is doing FBM it won't work cuz it takes so long for test buy, once you take down one they will back with another account

I had this happen to my listings a few years ago. It was because I didn't have a trademark in Canada. I did test buys and that didn't work. The only thing that worked was hiring an attorney to register the trademark. The good news is I was able to expedite the trademark because we showed there was an issue with counterfeit goods that resulted in bad reviews. The bad news is that I was never able to get the negative reviews from the counterfeit listings removed.
