Received Intellectual Property Complaint for TrademarkComplaintCounterfeit

On July 28, 2023 I received an intellectual property complaint for TrademarkComplaintCounterfeit. When I listed on the ASIN under catalog add product page everything looked normal so I listed my product. After I received the complaint I viewed the product on amazon.com as if I was a consumer trying to buy that product. I noticed all of the listing shows the correct brand and part number that I'm selling with the exception of the seller put their trademark in as the brand. I deleted the listing from my inventory and do not plan on selling it again, but the person who filed the complaint against me will not answer. I sell the genuine product mentioned in the listing, but because the seller put their trademark in the brand my receipts are getting rejected because they don't have that trademark on them anywhere. I spoke in depth with a US based account health support agent who agrees this looks like a targeted attack from a competitor and has escalated this to the internal team. The support person says they strongly believe Amazon will remove this complaint against me as this appears to be abuse. What happens if they do not remove this? I have an account health rating of 248 and all the emails I get every time I appeal this states that if I cannot successfully appeal the complaint the listing will be removed and my account could possibly be at risk for deactivation. I already deleted the listing so I'm not worried about the listing. With the complaint having a "high" impact on my account health is this going to take me in to the yellow range? Will this also impact my buybox percentage? This is the first time I have ever received an intellectual property complaint and the person that filed the complaint will not respond to me.

They do not have to respond to you. You listed a trademarked item under their brand and do not have adequate documentation (receipts are generally not acceptable proof).

Please take what Amazon support tells you with a grain of salt, as most of the time, they don't even know their own policies.

When you say 'because the seller put their trademark in the brand my receipts are getting rejected (emphasis added)' that sounds like you do NOT have invoices and are doing RA.

Is that the situation?
