Brand Registry provides no protection outside US

I was led to believe, maybe erroneously, that Brand protection on Amazon.com gave you protection in Canada and MX. That is definitely not the case I'm finding in a very painful way this holiday season.

Amazon.ca is being overrun with CN and KZ counterfeiters and Amazon.ca and Brand Registry could care less. First of all Brand Registry says use the "Report a Violation" tool but it won't work in Canada unless you've also got your Brand Registered with the government of Canada. my USPTO trademark is useless. I've since applied for CIPO since I became aware but of course this will take 6 months. By that time listings will be trashed.

If you report the violation to Amazon.ca as a non registered brand (outside of Brand Registry). You get messages that say the Brand is not a recognized brand in Canada. So get lost.

Does it matter to Amazon that CN and KZ counterfeiters are selling inferior products directly on your listings? No.

Does it matter to Amazon that ratings are dropping on your products listing because counterfeit sellers are getting bad product reviews? No.

You can't do a thing about it. Just let your listing go I guess is what Amazon is saying and let the throngs of sellers from CN just take over.

I had this happen in previous years with non registered Brands. Counterfeit sellers just drove the price down to nothing, sold inferior products and killed the listing. This is why I started registering Brands with Brand registry. To get some protection. But Alas that doesn't work anymore.

SO BEWARE - you need your brand/trademark registered in every single countries official trademark office you operate in. Brand Registry at just Amazon.com only works in the US now. So be very careful about expanding into other Amazon countries!

That is correct, in Canada we don't follow US laws, we follow Canadian laws.
