Amazon removed me from Brand Registry

Over a year ago, I originally created my listing as Generic, however, I registered my brand a few months ago and was able to get seller support to assign the ASIN to my brand. Although I was brand registered, the trademark was marked as pending so I could not report trademark violations for counterfeit resellers that plagued my listing.

I reported it to brand registry and included my order ID and photos of the counterfeit products but brand registry denied my report to take down the counterfeit sellers.

This all happened a few months ago and out of nowhere recently, my brand was removed from brand registry. I appealed and was given the following email:

“We have determined that the account has engaged in abusive conduct as outlined in the Intellectual Property for Rights Owners Policy (https://sellercentral.amazon.com/gp/help/external/U5SQCEKADDAQRLZ?referral=A2501IQ5UFD9HS_A1BORWT57NZRSP).As part of the appeal process, we conducted a detailed investigation using information you submitted, as well as information available in our internal systems.Our decision is final. New appeal requests may be declined unless new information is submitted.”

How can I convince Amazon that I did nothing wrong? I can’t phone in to brand registry and they do not listen to my email appeals

That would violate policy? Did Ed help you get this done by any chance? or some other 3rd party fixer?

My name is Dougal from the Community Manager Team and I am happy to assist with the issues you are experiencing with Brand Registry.

First, let me touch on the brand name change because as @Seller_4zBzdtgCyS9EI correctly stated, changing a brand name from Generic to another brand is against the Amazon Brand Name Policy.

I was only able to find 1 appeal that was just rejected yesterday so if you have any other appeals that were not accepted, I can take a look at those as well. Please provide the Case ID's and I can research.

I am also curious if you received any notification from Amazon Brand Registry stating that your report a violation access has been revoked. If you did, can you provide that case ID or date of the performance notification as well? I am hoping I can identify something that provides a reason for the removal and I can provide guidance on that.

In addition to the questions above, I see that your TM is still pending on the USPTO website so without a fully registered Trademark, you cannot file a counterfeit IP violation. Please reference the Intellectual Property Policy for Sellers - FAQ about Trademarks. about 3/4 of the way down the page, #8 "What is counterfeiting?" more completely describes the requirement to have a registered TM (not pending) in order to properly report a counterfeit violation.

I hope this helps and again, I am happy to take a deeper look if you can provide case ID's for me to look up.
