Sellers are selling under my listing without approval, selling completely different products

A seller (and its associate account) are selling on my listing without approval. My trademark is at pending state so I did buy its product and found its product is cheap, totally different with the price almost the same as mine. This is not just hurting my selling, my brand, but also a huge harm to the customers who viewed my product page and bought their counterfeit products.

I reported the issue with pictures as evidence but was rejected by Amazon team without explanation. The customers also complained on the seller's front page saying the product is different from product page, or even empty package received. But Amazon crossed the complaints and said this was fulfillment regard issue.

Now could anyone tell me how on earth is it a fulfillment issue and the counterfeit sellers are freely doing these harmful activities without any punishment?

You don't say if you are in Brand Registry or not, but Amazon won't do anything about it for a pending TM anyway.

With 'pending' applications they force you to do the test buys as you did. WHO did you report the problem to? For better results you need to report it on the BR pages, not the 'general' (almost useless) Amazon side.

Once you get final approval, you can TRY this --

WHITELISTING

It seems clear that Amazon is only allowing MAJOR brands to 'whitelist' which sellers are authorized.

It was suggested by one of the long term experienced sellers on a different forum that the following has worked successfully in the past. Amazon changes things so much it may or may not work now though!

Have your attorney send a carefully worded Demand Letter (by Certified Mail) to Amazon’s "Office of the General Counsel".

I would think that you would want to include appropriate paperwork showing ownership of the TM from the USPTO, proof of registration in Brand Registry, and, any links to cases and messages that show that SO FAR Amazon has refused to protect your brand.

Basically, you need to put Amazon on notice that you expect the protections promised by Brand Registry.

You can get brand registry with a pending trademark. Also get project zero, then kick them out.
