Generic Listings, 'Amazon's Choice,' and Brand Owner Approvals

I have a simple yet complex question. I know that listing a branded product as 'Generic' is not allowed on Amazon. However, I've noticed some sellers listing thousands of items under the 'Generic' name. How is this possible? I did a quick Amazon product search and found a seller using FBA selling a product labeled as 'Generic' with the 'Amazon's Choice' designation. Can you please explain this? Another question: If I apply to sell a product already sold by the brand owner and Amazon allows me to do so in the 'You can sell this product' section, should I be concerned?

Daryl here from our Forums team creating a bit of engagement with your post, although I do see that your comment is more emphasized in creating discussion with fellow collaborators, I'd like to provide my insight on this matter.
To answer your first question, Generic Products are unbranded products that do not belong to any identifiable brand. An unbranded product does not have a distinctive name or logo. For example, a mobile phone case that does not belong to a brand would not have any branding, so the product should use the string “generic” for the brand name field when creating a new listing.
Although, using another brand’s Intellectual Property in your generic product listing, or listing a branded product as generic, are violations of our listing policies. For more information, see our Brand Name policy.
If you try to change a product detail page or add offers on another seller’s generic product, you will receive a listing error. You will then be guided to create a new product by following the process as outlined in Add Products. For more information on error messages associated with the policy and the steps to resolve your issue, go to Error messages related to Amazon generic product policy.
