Is Anyone Facing the Same Issue? Chinese Seller Hijacking Our ASIN, Altering MSRP, Selling Counterfeits, and Controlling the Buybox
Hello fellow Amazon sellers,
I’m reaching out to share a serious issue that has been affecting our brand. If you’ve experienced something similar, I hope we can come together and raise our voices to request a systemic fix from Amazon.
We are a brand that sells posters created from original hand-painted artworks by a single artist. All images are protected by copyright, and we produce and distribute the products ourselves. We registered our trademark in the U.S. and have been selling on Amazon Canada for the past three years through Brand Registry linked to that U.S. trademark.
However, earlier this year, a Chinese seller hijacked our ASIN and started selling counterfeit products using our copyrighted images. Not only are they selling fakes, but they have also manipulated the MSRP and are offering discounts of 35–65%, which allowed them to take control of the Buybox.
When we opened cases with Amazon to report this pricing abuse, we were told "there’s no issue" unless we could prove it was a counterfeit. But here’s the deeper issue:
- We sell exclusively through FBA. The Chinese seller is using FBM with inflated shipping fees (2–3 times the item price) and delivery delays of 2–4 weeks.
- We purchased the item ourselves and confirmed it is, in fact, a counterfeit product using our image without permission.
- We filed a copyright infringement complaint and a brand threat report, but the listing is still active.
- Since our trademark is only registered in the U.S. (not Canada), Amazon would not accept our counterfeit claim as valid under the Brand Registry in Canada.
And here’s the most critical issue:
If this Chinese seller were truly engaging in parallel importation, they should be required to create a separate ASIN.However, they have instead joined our existing ASIN, manipulated the MSRP, and used deceptive discounting to win the Buybox—despite being completely unaffiliated with our brand.
This raises a fundamental question:
How were they able to register under our ASIN, change the MSRP, and sell fake products using our copyrighted content without being blocked by Amazon’s system?
We’ve been managing this ASIN in Canada for 3 years, and yet another seller was able to override our pricing and product listing structure. This is a clear structural flaw in ASIN governance and Brand Registry protection.
