Major Brand is using the Transparency program to create monopoly, against the policies.

Dear Amazon and the Transparency Program Team,

I am writing to bring to your attention a significant concern regarding the implementation of the Amazon Transparency program by Dyson, which appears to be in violation of the program’s intended purpose and policies.

Some of the included ASIN's: 

B0C2JBDYKZ, B09YS9N7H2, B0C2J8KJH9, B0CDNR1ZB6, B0C2JD5H7D.

As a seller on Amazon, I fully support the Transparency program’s goal to ensure product authenticity and protect both sellers and customers. However, I have noticed an inconsistent application of transparency codes on Dyson products.

It has come to my attention that Dyson is applying transparency codes exclusively to units sold directly through Amazon and not to products distributed through other sales channels. This selective application seems to contravene the spirit of the Transparency program, which is designed to ensure authenticity across all retail platforms, not just Amazon.

This practice not only affects the level playing field expected in the Amazon marketplace but also undermines the program’s credibility, as it appears to be used as a tool to restrict marketplace competition rather than to verify product authenticity.

In light of this, I respectfully request that Amazon reviews the requirement for transparency codes on Dyson products until such a time as Dyson adheres to the uniform application of these codes across all their distribution channels. We are in the same situation with another brand. This is getting problematic. I am sharing this with my account manager.

You understand the brand has the right to do whatever they wish with their own products right?

We have seen this happen dozens of times over past few years. My guess is you were selling Dyson products on Amazon that you purchased through a proper distributor. But You probably do not have an agreement with Dyson to sell their products on Amazon. There is a big difference between being allowed to sell their products and being allowed to sell them on Amazon.

I understand what you are saying about the Transparency program but ultimately, it is just another way for them to control who sells their brand and on what platform. Even if you might be an honest seller that sells for their MSRP there are hundred if not thousands of sellers that will sell knock offs or sell under or above the MSRP which negatively affects the brand.

You are wasting your time, efforts and energy fighting this system because it is working exactly as intended. They did not want you to sell Dyson products on Amazon and now you cant.

You are legally allowed to sell but that doesn't mean Amazon or the brand has to let you sell the products on Amazon.

Yes, it does allow me to resell on Amazon. Unless I have a contract with the brand owner preventing me from reselling on Amazon or unless I am directly incitating breach of contract between two other entities, I can resell the product on any platform with no legal obligation.

Yes, they can find each sellers distribution and cut that seller out but that requires an insane amount of time and effort for each seller. By the time they cut one seller out there would be 3 more listing the product.

The amount of efforts is irrelevant. This is the RIGHT way to proceed if a brand owner wants to restrict Amazon sellers. If the brand owner doesn't want to invest ressources, perhaps he could simply accept that Amazon is a free marketplace and resellers will list the products.

I hate it when a product requires transparency codes, we lost the ability to sell products that generated $300 000 +/ year just a few months ago. But I understand the brand has the right to enforce it.

I say that in all due respect, I can't argue further if you haven't spent time reading the guideline for the transparency program.

You are talking about the ''right'' to enforce who resells on Amazon, and I agree, I am only objecting to the way it has been done : the misuse of the transparency program and false complaints left on honest resellers.

The infrindgement of an Amazon program is simply not the way to achieve the desired results.
