Unauthorized sellers highjacking my brand, product and listing

Dear Fellow sellers,

I’m hoping to get some advice as the situation is really frustrating . I have launched my brand exclusively on Amazon 2 months and half ago.

My product listing has been taken over by unauthorized sellers, and it’s been a nightmare. Right now, there were six different sellers over the last 4 weeks offering counterfeit versions of my product at cheaper price and it’s really hurting my business.

I’ve tried everything I can think of—reporting through Seller Central, ordering the fake products to prove they’re counterfeit, .... But nothing seems to work. Every time one seller is removed, another one pops up.

I’m a registered brand owner (still waiting on my trademark, though), and it’s really disheartening to see these people trashing my brand’s reputation and profiting off my hard work. I’ve also been spending huge money on ads, and these counterfeiters are totally undercutting my prices.

Has anyone else dealt with this? What can I do to get these unauthorized sellers off my listing for good? I’d really appreciate any tips or advice.

My name is Sandy from the Community Manager team.

Amazon's policies allow any seller to list items for sale on an ASIN so long as the intellectual property accurately represents the item being sold and has not been illegally reproduced. This includes intellectual property for which you are the rights owner.

You mentioned that you have completed test buys to prove they are counterfeit. Currently with your trademark still pending, test buys will be the standard process in reporting items as counterfeit as without valid proof Amazon cannot take action.

When you report these as counterfeit, please make sure you are only stating facts of how it is counterfeit. Ex: Color differences, material differences, etc. Please also make sure that your PDP is up to date and accurately describes the product.

Once your trademark is approved and registered, you can use the Report a Violation tool via Brand Registry and report under Trademark Infringement "A product is counterfeit."
