Consumer Button Cell Battery flagged but product does NOT require battery

Consumer Button Cell Battery = All consumer products containing or capable of containing button or coin batteries—regardless of whether the battery(ies) can be replaced or not. button batteries look like small, squat silver cans from five to 25mm in diameter and one to six mm high — resembling a button.

A bunch of our listings got flagged for this but the item does not even require a battery to operate. Tried to Appeal twice on the 'Manage my Compliance' Page and got rejected both times as there is only one option to choose from on their dropdown.

welcome to the club. How similar to my case.

Amazon didn't help me. They rejected my appeals, and seller support did absolutely nothing. One thing I did find (which Amazon never mentioned) is that in my description of the product I mentioned that it withstood "acidic and alkaline water testing" (as the product is used in water). I think the word alkaline got me flagged, and amazon and their lazy gang that is too well-fed by sellers' losses simply didn't deal with the matter. They just don't care.

I am facing the same issue. My products do not contain coin batteries, but they were flagged because my product name includes the keywords "Sensor Button - Battery Included." I believe Amazon's algorithms flagged it as having a "Button Battery." I have already appealed twice and mentioned that my products do not come with button batteries, but my appeals were still rejected.

Eden Health unfortunately this is a losing battle.

Amazon AI bot is misapplying the law on the products. We've had mechanical iautomatic watches with no batteries removed in my wife's store. She finally gave Up and closed it. Amazon said she had to prove in documents from the OEM or a lab that ththe watch didn't need a battery (despite the fact that Mechanical Automatic is exactly that).

We have offered written feedback from a product liability attorney on the application of the law and how to determine exempt lisitngs or non exempt. They rejected it. Would not consider it. For example a device that could be subject but requires 2 hands or a tool should have a battery warning but they are demanding a Lab test result. Unfortunately you are looking at $500 Per lab test, 10 watch brands, 20 models each and that's $100K. Not business smart.

As an AD for some brands yes the OEM are making available documentation for inside the brick and mortar store etc BUT not making it available for online by restricting the agreement for online sales. A candid comment by Citizen wqs the over application of the law will increase Citizen AD sales that want to sell on Amazon and will drive away the non AD sellers who are buying wholesale and reselling on Amazon through the likes of ItalJapan etc. Their Reeses law compliance and the control of information about lab results and compliance forms means they have a stronger control on who gets to sell their product basically taking back marketshare control of Amazon watch sales.

You will see Amazon itself is selling the product and therein must have the documents themselves... but they aren't making the documents available to all registered stores. They have the documents from their own contracts and from others who have supplied them but there is no repository of compliance documents. Why? Because this is giving Amazon a chance to capture more of their own market share. This is why they have massively expanded Watch Sales in Amazon UK and Amazon Japan. They have compliance docs and are using it to

a. Target competitive products and reduce competition by flagging top selling watches first and driving their own in house sales up

b. ColluColliding with brands to represent and take market share control using this method

c. Collaborate with limited sellers to consolidate the number of sellers and increase fee volume from those sellers reducing the overall maintenance and effort required to have 1000 sellers. They csn simply have 25 that now sell globally and sign an advanced fee agreement.

So there won't be a solution. Product liability says the OEM has to comply not necessarily the seller AND there is a grandfather period for exist8ng on shelf product. But you won't hear about that from Amazon. It's a business.business move that They csn make to own the holiday market.

also, the label Amazon allows to be sold online for Reeses law compliance isn't compliancompliant and is getting rejected by them and by other marketplaces as well as was rejected by product liability attorneys. In the area of legal advice labels they don't mind non compliance as it's more fee revenue.

Basically if you have watches of any kind font be surprised if the top sellers are flsgges.flagged. out of 30 watches they tagged the top 9 sellers. No discrimination by brand. But when they tagged those top 99bthey Also added their own offerings the same time. Of a 164 watches on my wife's site 40+ automatiautomatics were delisted and zamazon added their own offering. Coincidence? No.

What's more interesting? We have exclusive brand authorization to represent in Nkrth America for 8 brands thst wanted help expanding. As a distributor we agreed and took on the Amazon listing responsibilities. Amazon rejected us and then we were notified that other parties representing Amazon contacted the OEM's coincidentally about Amazon representation. Coincidence? Not when we used a new unshaved phone number for the OEM was in place to be used to track Amazon customer direct inquiries. It had only been released to Amazon. And thst was the number the party called to offer Reeses law and representarepresentation through an agreement with Amazon and an Amazon preferred watch seller.
