Pesticide
Our products are not pesticide, however, they are still flagged as pesticide and removed from our catalog. We had submitted appeals and told account health team that the products which are not pesticides do not require the EPA or any other certifications from "Health Canada". The manufacturer's safety data sheets were also provided to them but they keep rejecting our appeals. Has anyone of you faced similar situation? Any help would be greatly appreciated since its really affecting our small family business.

I keep getting a car wash soap reported as a pesticide every few months because "it removes dead bugs off your car" is written on the label in small text. They won't change the category. People buy it thinking it's a pesticide sometimes too, but it's not.
You will have to get a seller forums moderator involved and cite your failed case numbers for escalation.

Greetings Perfections_576,
I wanted to reach out regarding the product you are selling that claims it can remove "muck". Based on the information I have received from the responsible team, products that make claims about removing or eliminating pests or other biological contaminants may be considered pesticides under relevant regulations.
The term "pesticide" can cover a broad range of substances used to control or eliminate organisms that are considered harmful, including insects, rodents, fungi, bacteria, and even algae or other microorganisms. Even if your product is not designed as a traditional insecticide or herbicide, if it makes claims about eliminating biological growth or contamination, it may fall under pesticide regulations.
To comply with these regulations, pesticide products typically need to undergo testing and receive approval from regulatory bodies before they can be legally sold and marketed. Selling an unapproved pesticide product could result in regulatory violations and penalties.
If your product does not require EPA or Health Canada certifications, and you have provided the manufacturer's safety data sheets to Amazon to prove this, but Amazon is still not accepting that, then you will need to provide stronger evidence.
Some additional documentation you could send to Amazon to demonstrate your product does not require pesticide registrations includes:
- Detailed product formulation information to show it does not contain any regulated pesticide active ingredients
- Third-party laboratory testing results confirming the product does not have pesticidal effects
- Formal legal/regulatory opinions from qualified professionals stating the product is not subject to pesticide laws
For more information, please see the following Health Canada link for Frequently Asked Questions regarding the sale of pesticides.
To be considered for reinstatement, please provide the following information when requesting reinstatement:
- The pest control product registration number
- Date of first registration
- Expiry date of registration
Proactively working with Amazon can provide comprehensive evidence that your "muck removal" product is not considered a pesticide requiring special registrations or approvals.
Please let me know if you have any other questions! I'm here to help ensure you are operating your business in a safe and compliant manner.
Best regards,
-Nikki
