New seller illegally using my legal business name and offering same products

There is a new seller using my legal business name on Amazon and offering some of the same products that I am authorized by the manufacturer to sell. The brand owner reached out because they thought the fake seller was me and that the offers on the ASINS violated their MAP policies. When I discovered there was another seller using my business name, I opened a ticket for support and reported the issue to the brand owner/manufacturer. The manufacturer reported the issue with them being on the ASINs as unauthorized. The display name on the sellers page is my business name. But the seller details on their page shows the seller with a different name and shows them in another country. Amazon responded to my case stating "We cannot take action on the report as no violation has been identified". But when I called Amazon they stated that they take this issue very seriously and are here to protect me. Then they referred me back to opening a case. I had provided the link to the fake sellers page as well. I need some help here. How do I get Amazon to stop this new FBA seller from using my legal, registered business name?

Unfortunately, legal business names are not protected. Only trademarks are.

If you have a trademark for your legal business name, you can remove the seller. If not, Seller Support will not see a violation as they have mentioned to you.

I'm assuming you are Brand Registered? If not then it means you likely do not even have a trademark and they can do whatever they wish. If yes make a case with brand registry support.

Business Names are not protected what so ever. So that as far as it goes, Will not get you anywhere trying to fight it. It seems you will be fighting a never ending battle .

if your supplier (brand owner) has brand registerd they should be able to report this seller to amazon as not authorized to sell their products.

We are experiencing a similar situation and have not received resolution, or an relevant guidance.

Business names are not protected, but they are in each state of incorporation/registration. Fraud however, impersonating someone else, is a crime if you can show it is done to deceive others into thinking they are you. You need to lawyer up. Go through brand accelerator to register your brand as a TM right away before they do. Once they try to register it, if they do, you have a fight to keep them from winning.
