We have our own A+content and images and the brand name is trademarked on TESS.
we have submitted multiple infringement reports to amazon for reporting this seller but Amazon has not helped us and saying only the information is not complete although everything has been submitted.
See the below attachment for proof that this our listing and A+content is also attached since our brand is registered.
Amazon should send a strike to this seller since he has copied our listing and not removing himself. Amazon should take serious action its been months.

You'll have to do a test buy and see if the item is counterfeit. If the items does not show up with your brand, then you can take action.
At this time in Amazon's eyes, the other seller has done nothing wrong as it is Amazon's policy that a seller is to NOT make a separate listing for the same item, and that all sellers of a same item have to be on a same listing. It doesn't matter about your photos and A+ content if the item is exactly the same and branded the same.

Yes, so you have to see if the item that shows up from another seller is your brand or not. The listing is for your Brand, not you.
Yes there is, it is Amazon policy that all sellers need to be on the same listing if the item and brand is the same.
You own the brand, but you do not own the listing or the content, Amazon owns the listing and the content.
If the other seller is your brand, then the other seller is doing nothing wrong and following Amazon policy. It would be against Amazon policy for the other seller to create another listing for the same brand and the same item.

Even if you are the listing creator and own the content and brand registry, it does not limit other sellers from listing it.
All sellers are under the same listing if they sell the same product. Otherwise, it would be a complete mess.
You should do a test buy to see what the other seller is shipping.

Some sellers around here need to educate themseleves about the matter. "You own the brand, but you do not own the listing or the content, Amazon owns the listing and the content."
This is simply FALSE. The content of your product listing, if created by you and is absolutely yours, it is created by the seller and is part of your intellectual property. Listing pictures created by the seller is the seller's intellectual property.
That's not the problem. The op is complaining that they are selling on the original brand's listing. The other seller hasn't copied any of their intellectual property or content and has not created a 2nd listing using op's content and property.

The other seller has not copied your content -- they are pretending to be an authorized reseller of the brand.
You, as brand owner, can ask amazon to remove unauthorized sellers (The Classy Fashion) from selling your brand. And that (Lecuir Elegant) is the only authorized brand seller at this time on amazon.
You as Brand owner and as Seller are treated as 2 different things by amazon.
AZ support is pretty wobbly when solving these type of issues. And I can understand why you do not want to do a test buy of a counterfeit product as proof the other seller is faking it.

They won't get a payout with a fake tracking number since Amazon's system won't pay out for at least a week after confirmed delivery via tracking, or 3 weeks after the last estimated delivery date if shipping untracked.
The sheer amount of item not received claims will cripple a scammers account metrics and get them suspended, and then they aren't paid out anything.

Well you have to do a test buy to see if it is counterfeit. You can't just say another seller is sending a counterfeit product without any proof.

Don't report this through Amazon customer service. go to your brand registry dashboard and report it.

Buy the product, send seller a message to stop selling (after you purchased) . Most times they will remove the listing from their store. It worked for us twice now as Amazon was not doing anything about it. I hope that helps
