Unauthorized seller on listing
What is the benefit of Amazon Brand Registry if you cannot remove unauthorized sellers from your listing? I have been trying to get an unauthorized seller from my listing for a month to no avail. IP, Trademark, copyright, other violation, nothing seems to be working. Why would Amazon even allow a seller to get on a brand registered listing? Had Amazon had stringent rules and enforcement, such as taking all the proceeds from unauthorized sellers and give it to the true owner of the listing, this would not have happened. It seems like a very common issue just by looking at the forums. very frustrating.

It seems clear that Amazon is only allowing MAJOR brands to 'whitelist' which sellers are authorized.
It was suggested by one of the long term experienced sellers on a different forum that the following has worked successfully in the past.
Have your attorney send a carefully worded Demand Letter (by Certified Mail) to Amazon’s "Office of the General Counsel".
These are the most recent addresses I could find for the legal beagles…………...

I would think that you would want to include appropriate paperwork showing ownership of the TM from the USPTO, proof of registration in Brand Registry, and, any links to cases and messages that show that SO FAR Amazon has refused to protect your brand.
Basically, you need to put Amazon on notice that you expect the protections promised by Brand Registry.

i have successful removed unauthorize sellers from my listings many many times. It is not that difficult at all if you do it the right way. Before I let you know how I have done it, can you confirm that you are indeed a registered brand owner in Amazon with an approved trade mark?

Amazon isn't here to help you control your supply chain if these are legitimate items (they specifically say that on the IP Complaint page). If they are selling counterfeits then I would escalate. If your supply chain is leaking I would deal with your supply chain.

I'm brand registered and I have these sellers on my Candian listings (I don't sell in Canada) selling my sku's at 3x-5x our US retail price. Pretty sure they are buying from our US Amazon store and drop shipping. When I go to their storefront it's just random products.

Hello @Seller_EbLfnpft9trDw,
My name is Dougal from the Community Manager Team and I would be happy to address your issue. As @Seller_NTtgyr4S9sRAA mentioned, please review the "We Do Not Enforce," section of the Report Infringement form.
I was only able to find 1 submitted complaint ID in Brand registry that was rejected. Based on the info you provided, If you have not already, please click on the right facing arrow in the status column in the complaint details. This will provide a list of 3 potential reasons your complaint was not accepted.
In addition, here are some help pages that provide best practices on what to include and omit in your complaints:
- Using the Report Infringement form - best resource to determine which type of infringement to use
- Intellectual Property for Rights Owners - best resource for IP infringement definitions, step by step instructions and best practices
- Report intellectual property infringements - best resource with Seller University video that has step by step instructions.
Also, while researching this I noticed that the trademark status on USPTO has changed to declined. Having a pending or registered Trademark is a requirement for enrollment in Brand Registry so I expect you may be removed from Brand Registry at some point.
I hope the resources help and please let me know if you have any additional questions on that or enrolling a new or another TM.
Best, Dougal

And THIS from @Dougal_Amazonis exactly why Amazon will NOT do very much of anything until a TM is active.
"Also, while researching this I noticed that the trademark status on USPTO has changed to declined. "
They would face HUGE liability issues for enforcing the UNenforceable.
When he says "I expect you may be removed from Brand Registry at some point. " what he really means is "I expect you may be WILL BE removed from Brand Registry..... "

I'm assuming you are referring to a listing like this, https://www.amazon.com/Thank-You-Stickers-Boutiques-Retailers/dp/B08F2ZKG5T?ref_=ast_sto_dp&th=1
You have the stickers branded as iBake but nowhere on the sticker does it say the brand name. All they are, are generic stickers. Not sure how your brand registry claim could fit in this scenario.

You are responsible for protecting your own brand.
If you have a registered trademark or copyright contact your attorney to send the offending seller a cease and desist notice copying Amazon's legal department.
Be prepared to file a lawsuit if necessary.
