How long does it take to approve brand registry application?

Hi. It has been 4 weeks since we applied for brand registry but our case is still under review. How long does it take to approve brand registry application?

Generally it's two to three weeks (10 business days the MODS usually quote can be more than 14 days depending on when you filed and started counting.)

Whole you wait check out this list to see if things will need adjusting if they reject it!

Here are some of the most common issues with BR.

Go over everything with a magnifying glass looking for a missing 'period' or 'comma'.

Is there a different capitalization, abbreviation, spelling, or, even an extra spa ce?

Is your Brand registered (or applied for) with the USPTO?

Amazon is admitting applicants under CERTAIN conditions when only filed but not granted.

“To be eligible for Amazon Brand Registry, your brand must have an active registered trademark in each country where you wish to enroll or have a pending trademark application filed through Amazon IP Accelerator. Brand Registry is also accepting brands that have a trademark pending registration in a subset of trademark offices.”

Additionally, IF you ever get an actual TM (if you don’t now) When Amazon says something must match they mean EXACTLY!

That means Street is not ST.

Jim is not James.

ALL CAPS is not SOme CAps

Thanks to Sandy_Amazon for letting us all know that Brand Registry applications are also space sensitive.

And so on………………..

They mean every comma, period, dash, etc. must be EXACTLY THE SAME INCLUDING SPACE S.

Go over everything with a magnifying glass looking for a missing 'period' or 'comma'. Is there a different capitalization, abbreviation, spelling, or, even an extra spa ce?

What is the EXACT BRAND (as GRANTED) on the USPTO site? Is it the EXACT same as the Brand on the Amazon account AND the brand on the packaging?

What is the name of the Owner (REGISTRANT) on the USPTO site? Is it the EXACT same name as the owner of the Amazon account?

If it is NOT exactly the same you will need to show some proof that the two are the same as to ownership! I had to submit my LLC State Registration with MY name as the owner of the LLCs since my Amazon Selling account and the LLC that I registered under are under different LLC names.

The OWNER of the Brand is the one that MUST enter into the Brand Registry agreement. If the owner is not the same as the Amazon seller the seller will have to be granted access by the owner AFTER REGISTRATION.

You might have to take a picture of it while holding it in your hand (unless it weighs 1000 pounds!)

Amazon can be 'weird' at times and I have seen where they ask for a handheld picture.

In addition, on one post @jim_amazon added this interesting reason for a rejection!

“One other piece of advice, I've some applications have issues when the 'Suggested ASINs' list is filled out incorrectly so I recommend leaving that section blank!”

  • It takes an average of 10 business days to review Brand Registry applications. In some cases, we may need additional information to verify your identity, which can extend the application review period.

That being said, 4 weeks sounds really long and I can definitely check in on what might be going on. Please provide your application case ID and I will take a look and see what I can find.

Amazon would be wise to become more stringent in their acceptance of Brand Registry applications since BR has been used a tool for Chinese national run accounts to file false IP infringement violations against their competitors who attempt to sell on ASINs which they authored. Creating duplicate listings including listings with unauthorized bundles that are embedded with the seller created trademark filed under the BR account that doesn't match the listing's brand which is always a big brand (i.e. HP) is the calling card of the Chinese sellers who open their accounts using private residences or forwarding addresses. Filing a dozen false IP infringement violations even in a single day against competitors in an attempt to get their accounts suspended for the false violations reported is the tactic used. This issue has become very prevalent so Amazon would be very wise to scrutinize all new applications for Brand Registry.

I have had my last 2 approved in approx 3-5 days, FYI.

If its been 4 weeks, than I think you need to look at what @Seller_kIukTwdhvntAp wrote and figure out the issue, as something has gone awry most likely.
