California’s Proposition 65 Lawsuit
We received email from legal counsel for Amazon in regards to alleged violations of California’s Proposition 65 related to the product we sell. The product is stainless steel tools packaged inside zipper bag. It has to be zipper bag, but not sure how zipper bag could violate Prop 65. Our company has less than 10 employees and as such is Exempt, but Plaintiff sued Amazon and due to Seller Agreement with Amazon as a Seller, I (and all Sellers) agreed to defend and indemnify Amazon with respect to this matter. If any of you had similar issue and willing to share your experience, I will be grateful for any advice and suggestions. Also, I need referral to an attorney. Your supplier should have given you the required information to comply with California's Prop 65 notification requirements. If they didn't or can not then you have a bad source.
The EU is much more strict than California but they do not use trial lawyers to enforce their regs.

Prop 65 is the most ABUSIVE, Lawsuit Mill, bs law. It was passed as the Clean Drinking Water Act and dimwit CA voters fell for it. I got nailed a few years back. The thing that really ticked me off is that the Plaintiff (on behalf of the state, ha!) knows the defense attorney that handles most of these claims (at least did back then) Sorry for the rant. I just went back and looked at who we used and I wasn't able to find it. Good luck.

We put the disclaimer on EVERYTHING, no matter what. Just safer. California is nuts (I was born there and moved), and there are others that follow along. Just CYT (cover your tush)!
