Brand Registry Continued Denial

Hello Gang,

I'd love your ideas on fixing this Brand Registry denial problem.

It's been about three months that my brand was initially approved by the USPTO, making it eligible for Brand Registry, as I am the brand owner.

I received a denial based on "abusive behavior" which was incomprehensible to me, as I know of nothing done wrong. I understand this is a catch-all term for what could be any number of things. I requested a review/appeal but received no response. Every few weeks I put in another appeal - hoping I'm not being abusive - but I never receive an answer.

My products just went live a few days ago, and I could so use the benefits of the Brand Registry marketing suite, but I am blocked, with no idea why.

I would be so grateful for any course of action on this.

Much thanks,

Rick

I received a denial based on "abusive behavior"
View post

Abusive conduct: that could be many things: getting free products for reviews and ratings as a customer, paying for ratings/reviews for you or other sellers, giving bad ratings to other sellers, buying the stock of competitors, clicking the ads of other sellers, hijacking branded listings, edit listings that you didn't create, attempt to take over listings, selling fake products on other's listing, introducing forbidden backend keywords in competitors listing aiming the deactivation of it..... and many more.

Amazon will NOT reveal what did you do. Just know that the bots see ANY movement you do on internet. Be happy if JUST the brand registry is denied, and you didn't get your account suspended. Actually you can't do anything. Just sell your brand without brand registry.

The term 'abuse' on Amazon is and can be extremely wide ranging.

Amazon found SOMETHING they don’t like and it could be something not even related to your account that is applying for Brand Registry.

Have you EVER had another account?

Have any family members or business associates had other Amazon accounts?

Has ANYONE ever logged into THEIR Amazon account from your home or business?

Have you ever logged into your account from a business location that had an Amazon account of their own?

Have any of the above individuals ever had accounts that have been closed or sanctioned?

Have you ever STARTED to open an account including those ‘Global Accounts’ and you did not finish the account application?

Are you, or HAVE YOU EVER, used one of the deadly Virtual Assistants?

Amazon links EVERYTHING that they can trace back to you and your IP addresses.

As @Seller_rI7BZIczK8iAC notes, it could even be something from ANY of the above that was 'abusive' on the BUYER side --

Too many returns, returning damaged items, using the WRONG reason for a return. etc.

The term 'abuse' on Amazon is and can be extremely wide ranging.

Actually got to talk to someone on the phone somehow and swore at them? Got MAD at them? All considered to be abusive behavior.

Hi @Seller_wesW0vTIczUBg

Both @Seller_kIukTwdhvntAp and @Seller_rI7BZIczK8iAC offered correct advice in that Amazon will typically not disclose the exact reason for their decision and that a multitude of things could have caused this. Below are some common pitfalls we see when Sellers receive this message:

1. Documents are not valid - this includes documents that don't fit the criteria that brand registry is asking for.

2. Manufacturing agreement - some sellers commonly attach invoices for these. The invoice is not a valid for of letter of authorization and listed in the invalid type.

3. Documents are not authentic and forged.

4. Attorney that is listed on the trademark is sanctioned by USPTO or Amazon.

5. Seller has low Account Health metrics, or other selling accounts in bad standing (terminated, deactivated etc..)

Again, these are just commonalities for the situation.

I highly recommend reviewing the above points along with the application requirements closely and feel free to attempt to reapply.
