unauthorized sellers from Canada

Hi!

We are a registered brand in Amazon’s Brand Registry and we’re struggling with unauthorized sellers listing our products on Amazon.ca.

We are selling our manicure products MADE IN GERMANY successfully on the Canadian and US marketplace.

Some products are offered in the US but NOT in Canada.

Now we do have the situation that unauthorized sellers from Canada are offering our US products next to our listing in Canada – without our knowing and permission! How could they able to enter our listings? We are not able to remove them although we are the registered brand owner. Deleting the listing and creating a new one is of no use.

These unauthorized sellers are creating inconsistent variations families, for example nail scissors (ASIN B07TH916HH) next to nail files (ASIN B08538YWF6) = completely different categories.

Further these sellers triple or quadruple our prices. They all do have bad seller feedbacks and they just copying thousands of products to deceive unsuspecting customers.

THIS IS EXTREMELY CONFUSING FOR ALL OUR CUSTOMERS AT CANADIAN AMAZON MARKETPLACE AND IT IS DISTURBING OUR BUSINESS IN A HEAVY WAY!

This is a clear violation of Amazon’s detail page manipulation and trademark misuse policies.

We have submitted multiple IP infringement reports through Brand Registry, but they are coming back as “not accepted”—with no clear explanation.

We’d really appreciate any advice, tips, or shared experiences on how to deal with this. It's been ongoing for far too long and we just want to protect our brand.

Should it be connected with a Canadian registration, too?

If you don't have a trademark registered in Canada, then anyone can use and sell your trademark in the Canadian marketplace. There's nothing illegal going on here since you don't have a trademark. Canada is not part of the European union.
