Amazon not Collecting Sales Tax on orders it should

I have tried contacting Seller Central about this several times. I was on a chat with someone for over an hour yesterday, they said the 'tax team' would contact me about this, they apparently couldn't figure it out. The next message I get is about REPORTS, which is NOT THE ISSUE.

Case# 14968091931

Amazon is not collecting sales tax on sales to Florida. I am in Florida. I am supposed to be collecting sales tax to sales here. This was fine before Amazon took over collecting this, they charged the customer, then paid me, and I paid the state. Now that Amazon is managing it, THEY ARE NOT collecting sales tax in Florida.

All my products are coded A_GEN_TAX. It collects sales tax for other states, but not Florida.

I have no way to change settings that I can find, because it says it is managed by Amazon.

img

I am at my wits end. No one can seem to understand that it isn't a REPORT issue, it is that they are NOT COLLECTING THE TAXES AT ALL.

Order number for example: 112-6442591-5338622

I don't know how else to explain it to Seller Central. All I get back is unhelpful links to help pages. This needs an ACTUAL THINKING PERSON to look at it and either tell me what is set up wrong, or FIX THE BUG.

When listing your products, what did you put in the Product Tax Code field? Have you tried updating it via a flat-file upload?

This is now between Amazon and the state of Florida.

Sellers have zero control / zero responsibility for sales tax collection.

You almost certainly still have to file, but you cannot be liable for sales tax for Amazon sales because it is impossible / illegal for you to collect or attempt to collect sales tax for those orders.

With the Marketplace Facilitator agreement, third party sellers are out of the loop as far as sales tax goes.

UPDATE: The latest reply from Seller Central is that all these sales have Tax Exemption Certs. THIS IS UTTERLY IMPOSSIBLE. Also, I checked all the way back to JAN 2023 and NO ORDER has a tax exemption certificate. NONE.

I have removed myself from the Tax Exemption program to see if that will solve this problem.
