Seller Account Creation

Hello Everyone,

my name is Cynthia (Canadian Seller based in Canada) i have an active professional account registered under my full name that use to do wholesale in both the U.S & Canadian Marketplaces.

at this phase, i am in the process of developing my own product and want to start doing private label & my main Marketplace target is the U.S Marketplace, before i do any mistake, i need your help so please can enlighten me:

1- I want to create a separate Amazon Seller account (2nd account) under a registered company & then start the brand registry process. is that permitted? knowing i have a professional account registered under my personal name.

2- in order to sell my Private Label Product/Brand in the states & as a Canadian seller, do i have to register an LLC in the states? if not, will inc. company in Canada do the Job?

i really appreciate your help in guiding me to do this in a safe manner and to avoid any headaches.

Thank you so much.

For a second account make sure you get permission from amazon to avoid any problems.

For USA sales are you shipping from Canada or are you going to use Amazon FBA for american sales ?

Hello Cynthia (@Seller_zV61aphzfyY1P),

Thank you for your query. Here are the answers to your questions:

  1. Yes, you can create a separate Amazon Seller account under a registered company and then proceed with the brand registry process. Amazon allows sellers to have multiple seller accounts, provided that each account is associated with a distinct legal entity (individual or company). Since you already have a professional account registered under your personal name, creating a new account under a registered company is permitted.
  2. No, you do not necessarily have to register an LLC (Limited Liability Company) in the United States to sell your private label product/brand on the U.S. Amazon marketplace. As a Canadian seller, you can sell on the U.S. marketplace using a company registered in Canada.

However, it's important to note that if you plan to have any physical presence (such as warehousing or employees) in the United States, you may need to register your business entity there as well. Additionally, if your sales volume in the U.S. exceeds a certain threshold, you may be required to register for sales tax collection and remittance in various states.

In your case, since you are based in Canada and selling online through Amazon's platform, an incorporated company (Inc.) registered in Canada should be sufficient to get started. However, it's always a good idea to consult with a legal professional or tax advisor to ensure compliance with all applicable laws and regulations in both Canada and the United States.

By following the proper steps and setting up your accounts correctly from the beginning, you can avoid potential headaches and ensure a smooth start to your private label business on the U.S. Amazon marketplace.
