All of a sudden, some of my ASINs B0DHNV75VG, B0DNVVPY4B,B0DLFWWBCR

were inactivated with the following reason.

This product has been identified as a dietary supplement that does not meet Food and Drug Administration (FDA) labeling requirements. We have determined that the amount of botanical extract per serving on the label is inaccurate and/or misleading. Labeling recommendations for botanical extracts shall be according to criteria described in 21 CFR 101.36 and/or USP <565> Botanical Extracts. Amazon policy prohibits dietary supplement products that do not meet FDA labeling requirements. Violations of this policy may result in the deactivation of your selling account. I appealed to the inactivation.one agent suggested that I upload live pictures of all sides of the products. I did so.. and reappealed.However, my appael is rejected without any suggestion to try to fix. They just said that after careful review the product did not meet the criteria( ????) To reinstate listings.

I am STUCK with no guidence.

Can anyone PLEASE shed me some light?

Looking at the help page Dietary Supplements Policy, under "Our policy for dietary supplements," Amazon requires third-party verification that "Products contain the ingredients claimed on the product label" and specifically mentions botanical extract content must meet "tolerances listed in 21 CFR 101.36 and 101.9(g)(3) & (g)(4)."

For botanical extract content verification, Amazon requires testing by one of these approved third-party verifiers:

  • Eurofins
  • UL
  • NSF International

Here's what you could try next:

  1. Visit your Manage Your Compliance dashboard
  2. Click "Add or appeal compliance" next to your affected products
  3. Choose "Request lab service" to get the required third-party verification

One important thing to note - in the "Our policy for dietary supplements" section, it mentions this verification needs to be renewed annually to maintain compliance.

We're in the same situation, with a few products removed and lacking guidance from Amazon since we can't include compliance in our compliance manager. The Amazon seller support team initially requested us to upload pictures of our product. Now, they are asking us to provide proof of our supplement facts. We will proceed by uploading our NSF COA. I assume that they might next request third-party testing, which we had previously inquired about, and they had informed us it was not required. (Case number: ID 17188832501)

I did go ahead and review the information available for the ASINs you have provided in addition to the case you shared. I was able to see where our team did reject your appeal due to the labeling requirements still not being met. We did review the information relating to the product and label, and did have concerns regarding the way in which the ingredients are being presented on both the label and the product detail page.

When we review what is currently on the label, we did identify where there does appear to be a lack of specificity on the ingredients and how they are measured in the product. For example, you have 100 mg for the ingredient 'Ginger', but there is an additional amount listed below in the mineral blend which includes 9 other ingredients that have also not been labelled for the total individual amounts.

As for the product detail page, there does appear to be several misrepresentations of the overall amounts of the ingredients listed. Another example, you have the Black Seed Oil listed as 6000mg in the title, but in actuality it is 400mg of Black Seed that is equivalent to the raw Black seed Oil. This, in addition to the other label concerns, could be considered misleading for the product and should be reviewed.

Please be aware that if you do intend to make adjustments to the packaging, you will need to create a new ASIN to go along with the changes. Without the clarification on the ingredients listed, we cannot guarantee a resolution for the overall concerns that are impacting these products.

We do encourage you to continue to refer to this thread with any new information or updates that you receive so we may continue to review the situation.

While some mods like Atlas are great, you can find some expert help if you do as I suggest. The people who really know this area (and I mean 7-8 digit sellers) left here for another forum. Search for it, as I suggested. Don't get hung up on getting your answers only from here.

How did you upload the photos? Makes sure it was done Catalog > upload images. A LOT of times when uploaded to the ASIN through Inventory.. it does not stick.. Then once the photos show do a screen shot.

I know exactly what you are going through.. I was smartarse steve by 5th appeal on asins like this pretty much pointing out willful uneducated-ness and then sooner or later it goes in front of someone who was lucky to get that 2nd brain cell and they accept the appeal
