Brand Owner with Unauthorized Seller
We are a large brand owner and have an unauthorized seller jumping on a sku we do not sell to them. They are using our content to sell whatever lime plant it is they have. We tried to report copyright infringment since it is our brand and our item but you are asking us for an order number. We are stating this seller is jumping on our listing unauthorized. Several tickets later and Uncommon Eden is still selling on our listing undercutting the price. Help with this please?

Your lawyer will have to send a letter to amazons legal demanding they protect your brand. Nothing you say to customer service will get any results.

As long as you have brand registry you process a test purchase to authenticate the item. If it is not authentic you can report the seller through brand registry.

Hi @Seller_DFboIuAYYf4KF
My name is Sandy from the Amazon Community Manager team.
I will have to look into your brand details and ASIN to determine the best course of action. Would you send me a case ID that you have on this topic?
For your information, Amazon's policies allow any seller to list items for sale on an ASIN so long as the intellectual property accurately represents the item being sold and has not been illegally reproduced. This includes intellectual property for which you are the rights owner.
If you prove that the item is counterfeit through test buys, please use the Report a Violation tool to report if you are registered with brand registry.
I can also take a closer look at your submissions once I receive the case IDs. Thank you.
Sandy

Did that unauthorized seller submit the protected content or was it you and he is just selling under the same asin? Is he selling your product? If it was you that uploaded the protected content AND he is selling your item, albeit, without your "authorization", thethen get over it.
when you agreed to sell your brand on Amazon and uploaded your protected content, you gave permission to all who use Amazon as well.
please look up Amazon detail page and image ownership policy. Learn it.

Get this in yours mind. It is NOT your listing. Once you create it, it is Amazon's listing and open to anyone selling that item. You need to tighten up your supply chain so product isn't leaking out to sellers you don't wish it to

"Unauthorized" doesn't matter, only "counterfeit" matters, at this point. Not sure how you prove a plant is a counterfeit, though.
The listing, https://www.amazon.com/dp/B0BWNLJQDZ, also begs the question of the brand being used. Why is this a GSB branded item and not Saxon Becnel & Sons? Are you *certain* that Uncommon Eden isn't also carrying Saxon Becnel & Sons products? Is that "Saxon" name part of your company, too?

Selling something that many other are selling ( same exact item) but with private label with your registered brand does not protect you and whoever carry that item can sell on your listing if you are not big brand or the product is not patented.
