Plant and Seed Products

Important: If you supply products for sale on Amazon, you must comply with all federal, state, and local laws and Amazon policies applicable to those products and product listings.

Our policy: You must comply with all applicable federal laws when selling plant and seed products. You must also comply with provincial and local laws applicable to the jurisdiction into which your products are sold as well as the jurisdiction from which you ship. For example, certain provinces may have shipping label requirements when shipping a live plant. In addition, you are responsible for obtaining any required licenses and permits and are liable for any penalties resulting from non-compliance.

The following examples of permitted and prohibited listings are not exhaustive, but should be instructive in evaluating products for listing and sale.

SKU prep and labelling requirements

All plants, plant products, and seeds that are sold on Amazon.ca must meet all applicable federal, provincial, and local shipping, packaging, and labelling requirements, including those set out in the Seeds Act, the Fertilizers Act, and related regulations.

Importation requirements

All plants, plant products, and seeds that are imported from outside of Canada must meet all importation requirements, including Canada Food Inspection Agency (CFIA) import permit requirements.

Fertilizers

Fertilizers are substances, or a mixture of substances, used to provide nutrients to a plant in order to increase plant growth or crop yield. Fertilizer products may be subject to federal, provincial, and location regulations, such as registration with the CFIA.

Examples of permitted listings

Plants, plant products, and seeds that are:

  • not prohibited by the CFIA
  • not prohibited by applicable provincial or local government quarantines
  • sold by licensed vendors and sellers
  • in compliance with all other legal, regulatory, and licensing requirements

Examples of prohibited listings

Plants, plant products, and seeds that are:

  • designated by the CFIA as “noxious” or similarly classified by applicable provincial or local government authorities
  • subject to federal, provincial, or local government quarantines
  • taken, possessed, transported, or sold in violation of the Convention on International Trade in Endangered Species (CITES)
  • dangerous or fatal when touched or consumed (such as the pong pong seed)
  • not in compliance with all other legal, regulatory, and licensing requirements
